Resolution No. 2009-10-12: Resolution for Ballot Initiatives Regarding the Instructionally Related A

SUBJECT: Resolution for Ballot Initiatives Regarding the Instructionally Related Activities (IRA) Fee increase and the proposed Materials, Services and Facilities Fee

1.) WHEREAS, an Associated Students general election is to be held on April 20th, 21st, and 22nd, 2010; and,
2.) WHEREAS, The Associated Students of Humboldt State University believe in the democratic process and the rights of individuals to make decisions about issues that affect their lives; and,
3.) WHEREAS, Three student fee increases (Counseling and Psychological Services Fee, Instructionally Related Activities Fee, and the new Materials, Services, and Facilities Fee) have been proposed to the Student Fee Advisory Committee (SFAC); and,
4.) WHEREAS, SFAC recommended a referendum for all three student fees requests; and,
5.) WHEREAS, only the Counseling and Psychological Services fee has gone through the appropriate measures necessary to be placed on the ballot. Therefore be it
6.) RESOLVED, that the Associated Students of Humboldt State University finds it disappointing that for various reasons, a referendum has not been pursued on the remaining two fee proposals; be it further,
7.) RESOLVED, that the Associated Students on Humboldt State University is concerned with the double standard given by the University Administration that students should vote in California State Elections but should not be able to vote on University issues that affect them; be it further,
8.) RESOLVED, that the following questions be placed on the Student General Election Ballot for the election of April 20th, 21st, and 22nd, 2010 in addition to the Counseling and Psychological Services fee already on the ballot;

Student Fees:
1) Should the Instructionally Related Activities (IRA) fee be adjusted from $272/semester adjusted by the Higher Education Price Index (HEPI) to $272/semester adjusted by the HEPI plus 2%?
a. Yes
b. No

2) Should a new University wide Materials, Services and Facilities Fee in the amount of $72.00 per semester adjust by the Higher Education Price Index (HEPI) for part-time students and $144.00 per semester adjusted by the HEPI for full time students , in order to fund extra curricular classroom and educational support activities be established?

b. No

9.) RESOLVED, the this resolution be sent to, but not limited to, CSU Chancellor, Charles Reed; Humboldt State President, Rollin Richmond; Vice President of Student Affairs, Steven Butler; Provost and Vice President of Academic Affairs, Bob Snyder; Vice President of Administration, Burt Nordstrom; the Student Fee Advisory Committee; and all campus and local news outlets.

3.) WHEREAS, Students have expressed concern regarding the smoking areas on campus and the disregard of such areas by a portion of the campus community; and,
4.) RESOLVED, that the following questions be placed on the Student General Election Ballot for the election of April 20th, 21st, and 22nd, 2010 in addition to the Counseling and Psychological Services fee already on the ballot;

Smoking:
1) Should all forms of smoking be banned on campus?

1.) WHEREAS, The Associated Students of Humboldt State University have been entrusted to voice the interests, concerns, and opinions of the students to the faculty, administration, and local community; and

2.) WHEREAS, The Associated Students of Humboldt State University have witnessed a rapid increase in the cost of education. The combined cost of textbooks, tuition, student fees, and living expenses have forced many students to take out excessive loans; and

3.) WHEREAS, It is prerogative of professors at Humboldt State University to select which textbooks will be used for their classes; therefore, be it

4.) RESOLVED, The Associated Students of Humboldt State University supports the creation of the Steering Committee on Affordable Learning Solutions and looks forward to its recommendations to the campus community; and be it further

5.) RESOLVED, The Associated Students of Humboldt State University encourage professors to research the textbooks choices with consideration to price for students; and be it further

6.) RESOLVED, The Associated Students of Humboldt State University supports the efforts of faculty to provide students with access to e-books, which provides students with online and downloadable versions of textbooks for a fraction of the cost of traditional paper textbooks; and be it further

.) RESOLVED, The Associated Students of Humboldt State University also support professors who prepare their own instructional materials that are used in place of purchased text; and be it further

Resolution No. 2009-10-15: An Act to Amend the Associated Students Fiscal Code

SUBJECT: An Act to Amend the Associated Students Fiscal Code

WHEREAS, The Associated Students financial support for travel for clubs (including sport clubs) and organizations is intended to support student travel only, and

WHEREAS, The code sections related to Clubs, AS Organizations and Sports Clubs travel does not specifically state this intention; and,

WHEREAS, this clarification requires an amendment to the Fiscal Code in the following manner; therefore,

BE IT ENACTED, by the Associated Students Council that the following underlined amendments are made to the Associated Students Fiscal Code.

Section 13 A.S. Clubs and Organizations Travel Account

13.01 Purpose - Travel funds shall be made available through the A.S. budget process to recognized clubs and A.S. organizations. These funds shall be administered by the Office of Clubs and Activities. (12/00)

13.02 The Club Coordinating Council (CCC) shall review the travel fund requests and award monies for distribution based on the following guidelines and criteria. (12/00)

Guidelines:
a. Travelers must be student members of the recognized club or organization they represent;
b. Students must be regularly matriculated, currently enrolled to receive AS funds. Non-students will not be funded.
c. Funds are allocated on a matching basis;
d. Receipts from all expenditures must be turned in before reimbursement will be given; and
e. Assistance will be considered only in the areas of conference fees/activity dues, transportation, and lodging. Meals (or per diem) will not be funded.

Criteria used in reviewing travel requests:
a. Number of students participating;
b. Indirect benefits to the students and to the university community;
c. Success of efforts in obtaining funding from other sources;
d. Planned efforts to share the experiences or knowledge gained from the trip with others upon returning; and
e. If the club has received funding in the past and the extent to which funds were utilized.

Section 14 Sport Clubs

14.01 Purpose - Sport Club funds shall be made available through the A.S. budget process to recognized Sport Clubs. These funds shall be administered by the Recreational Sports Office. (12/00)

14.02 Students must be regularly matriculated, currently enrolled to receive AS funds. Non-students will not be funded.

14.03 Recognized clubs whose primary purpose is to promote and compete in athletic competition will be eligible for A.S. funding through Sport Club Council travel monies only. (12/00)

Resolution No 2009-10-16 Resolution Against Hate Crimes on College Campuses

SUBJECT: Resolution In Support of a Speedy Recovery of Joseph Igbineweka and Against Hate Crimes on College Campuses

1.) WHEREAS, The Associated Students Council of Humboldt State University (HSU) has been entrusted to represent and advocate for the best interests of our constituents, the approximately 8,000 students which make up our campus community; and,

2.) WHEREAS, It is the mission of the Associated Students to provide an official voice through which studentsäó¢íó_í_Œé opinions may be expressed; assist in the protection of the rights and interests of the individual student and the student body; and,

3.) WHEREAS, On April 18, 2010 the President of Associated Students, CSU Chico, Joseph Igbineweka, was attacked and continuously stabbed in what police allege to have been a hate crime; and,

4.) WHEREAS, Shortly prior to this incident the campaign materials of a candidate for Associated Students President at CSU Chico, Amro Jayousi, were vandalized with racial slurs; and,

5.) WHEREAS, Racially charged and hateful incidents have occurred at Humboldt State University within the past year such as racial threats made to a professor on campus; and,

6.) WHEREAS, there have been reports of various acts of racism throughout the University of California, California State University, and Community College systems, most notably racist incidents at UC San Diego and homophobic incidents at UC Davis; therefore be it,

.) RESOLVED, that the Associated Students of Humboldt State University wish a speedy recovery to Joseph Igbineweka as he recovers from his injuries; and be it further,

8.) RESOLVED, that the Associated Students of Humboldt State University encourages the city of Chicoäó¢íó_í_Œés law enforcement to act swiftly to bring these perpetrators to justice; and be it further,

9.) RESOLVED, that the Associated Students of Humboldt State University condemns all acts of violence on our university and other college campuses throughout California, and be it further,

10.) RESOLVED, that the Associated Students of Humboldt State University encourages HSU, along with all other CSU campuses to continue, and enhance, its efforts to support diversity and provide a safe learning environment for all students; and be it further,

11.) Resolution in Opposition of the Proposed IRA Fee Increase

SUBJECT: Resolution in Opposition of the Proposed IRA Fee Increase

1.) WHEREAS, The Associated Students (AS) serves as the official voice of the students at Humboldt State University (HSU); and,

2.) WHEREAS, The Associated Students mission is to "provide a means for responsible and effective participation in the governance of the campus; foster awareness of these opinions with the students of HSU; assist in the protection of the rights and interests of the individual student and the student body… and to stimulate the educational, social, physical and cultural well-being of the University community;"; and,

3.) WHEREAS, Humboldt State University Associated Students believe in the democratic voice of the students and the rights of students to be aware and involved in issues that affect their education; and,

4.) WHEREAS, Executive Order (EO) 1034, the California State University Student Fee Policy, Section B-1 says "that appropriate and meaningful consultation includes consultation with bodies such as the campus faculty senate, the campus student body association and other constituencies affected by the proposed increase in an existing fee or establishment of a new fee"; and,

5.) WHEREAS, Section B-2 goes on to say, "The policy presumes that a student fee referendum will be conducted before adjusting or establishing category II fees." and,

6.) WHEREAS, Section B-3 states, "If a referendum is not conducted prior to adjusting Category II fees or requesting the chancellor to establish a new Category II fee, the president must demonstrate to the fee advisory committee the reasons why the alternative consultation methods selected will be more effective in complying with this policy"; and

7.) WHEREAS, The Instructionally Related Activity (IRA) fee increase being proposed will not be governed, allocated, or administrated by the IRA Committee; and,

8.) WHEREAS, The Academic Senate, AS and the IRA Committee were not consulted about this fee request increase and Associated Students believes this to be a in violation of EO 1034 designed to protect the students and provide administrative transparency; and,

9.) WHEREAS, The proposed fee has not gone though the student referendum process and no alternative consultation methods have been employed; and,

10.) WHEREAS, The proposed fee increase is an increase from $259 to $274 with an additional increase each year based on the Higher Education Pricing Index +2% generating approximately 80,000 dollars from students for the 2009/2010 year; therefore be it,

11.) RESOLVED, that Humboldt State Associated Students urges that a student fee referendum be called in the fall of 2009 prior to any fee increases; and be it further,

12.) RESOLVED, that the Student Fee Advisory Committee not approve this fee increase until a student fee referendum can be called; and be it further,

13.) RESOLVED, that the campus governmental bodies such as HSUAS and Academic Senate and the IRA Committee be consulted about this proposal prior to fee increases; and be it finally,

14.) SUBJECT: Resolution in Response to Administrative Memorandum VPAA 09-01 (Department of Nursing and Department of Psychology)

1.) WHEREAS, The Associated Students of Humboldt State University held their annual election in spring 2009 and elected three representatives to the College of Natural Resources and Sciences to the 2009-10 Council with terms starting May 4, 2009; and,

2.) WHEREAS, The University proposed and implemented a change to move the Department of Nursing and the Department of Psychology from the College of Natural Resources and Sciences to the College of Professional Studies and notified the campus of the changes on July 24, 2009 to be made effective on July 31, 2009 in Administrative Memorandum VPAA 09-01; and,

3.) WHEREAS, Two Council Members; Stephanie Partlow and Nathan Rudberg are Psychology Majors and were elected and began their terms as representatives of the College of Natural Resource and Sciences; and,

4.) WHEREAS, the Associated Students governing documents are silent on the issue of reorganization of majors within the colleges and its effects on seated members of the Associated Students Council and the Associated Students Government Code section 2.03 states: The Associated Students Council shall adjudicate all matters brought before it on behalf of the Associated Students except as otherwise defined in this document or the constitution; therefore be it,

5.) RESOLVED, that the Associated Students of Humboldt State University approve an exemption for Partlow and Rudberg and allow them to continue serving as representatives for the College of Natural Resources and Sciences; and be it further,

6.) RESOLVED, that the exemption for Partlow and Rudberg be conditional for only the 2009-10 academic year and if they maintain enrollment within the Psychology Major; and be it further,

7.) RESOLVED, that should a vacancy occur in either position the newly appointed representative must be currently enrolled within the College of Natural Resources and Sciences; and be it finally,

8.) Resolution No: 2009-10-2 - An Act to Amend ARTICLE IV, Section B of the Associated Students Constitu

SUBJECT: An Act to Amend ARTICLE IV, Section B of the Associated Students Constitution, and the Associated Students Government Code and Elections Code

WHEREAS, The Associated Students of Humboldt State University currently has two All University Representatives that represent Undeclared and Interdisciplinary students and has faced continued difficulty filling both positions due to the small number of eligible students. The Associated Students recognize that needs of the students may be better met with a full AS Council by deleting one All University Representative position from the Council and replacing it with one At-Large Representative by amending the AS Constitution and Codes in the following manner; therefore,

BE IT ENACTED, by the Associated Students Council that the following amendments are made to Article IV, Section B of the Associated Student Constitution:

B. Membership: Membership on the A.S. Council shall consist of college-specific representatives, two all university representatives one all-university representative, one at-large representative, and one graduate student representative.

Membership shall also include one Residence Hall Association (RHA) representative elected in the Spring RHA elections and seated by AS Council by a two-thirds majority. BE IT ENACTED, by the Associated Students Council that the following amendments are made to Article VII, Section C of the Associated Student Constitution:

1. Nominations: Executive Officers shall be nominated by petitions signed by one-hundred and fifty (150) members of the Association. A.S. college-specific representatives shall be nominated by petitions signed by fifty (50) members of the Association within the college he/she is representing. The A.S. All University representatives shall be nominated by petitions signed by fifty (50) members of the Association within the All University Program. The A.S. At-Large representative shall be nominated by petition signed by fifty (50) members of the Association. Graduate Student representatives shall be nominated by petitions signed by twenty (20) members of the Association who are Graduate Students. Petitions for nomination shall be filed with the Elections Commission not less than fourteen (14) calendar days not more than forty-two (42) calendar days prior to the regular election; the Elections Commission has three (3) school days to rule on the eligibility of a candidate after filing; and public notice to the effect that nominations are in order shall be posted on official bulletin boards and shall be published in the school newspaper at least forty-two (42) days prior to the election by the Elections Commission.

3. No member of the Association shall vote for a candidate for representative of a college other than the college in which that member of the Association is enrolled. In the case of persons with more than one major, the person shall have the right to choose from amongst colleges in which that person is enrolled to vote for a college representative candidate. Students with undeclared majors shall vote for the all university student representative. All students may vote for the At-Large Representative.

BE IT ENACTED, by the Associated Students Council that the following amendments are made to the Associated Students Government Code:

2.02 Membership on the Associated Student Council shall consist of thirteen (13) representatives — nine (9) College representatives (three from each college of the University), two one (1) All University representatives, one (1) At-Large representative, one (1) Graduate representative and one (1) Residence Hall Association representative.

The College representatives shall consist of the following:

1. College of Professional Studies

2. College of Arts, Humanities and Social Sciences, and

3. College of Natural Resources and Sciences.

BE IT ENACTED, by the Associated Students Council that the following amendments are made to the Associated Students Elections Code:

13.09 Members of the Association shall vote for candidate(s) for representatives of the college in which that member is enrolled. All University Students with shall vote for an All University student representative candidate. Graduate student members shall also vote for a Graduate student representative candidate. All members of the Association may vote for the At-Large representative candidate.

BE IT ENACTED, by the Associated Students Council that the following additions are made to the Associated Students Elections Code and that the code is renumbered accordingly:

7.07 A.S. At-Large Representatives shall file a Petition for Candidacy form signed by fifty (50) members of the Association.

7.10 Candidates for At-Large Representatives must be a registered student for at least the semester prior to filing for candidacy and may be of any major or undeclared.

SUBJECT: Resolution in Support of the Observance of a Moment of Silence on September 11, 2009

1.) WHEREAS, The Associated Students of Humboldt State University (HSU) recognize that the attacks of September 11, 2001 affected all Americans and the world, not just the direct victims and their families; and,

2.) WHEREAS, The Associated Students members and representatives acknowledge the tragedy that took place on this day and refuse to forget the sacrifice that was willingly and unwillingly made by the victims, their families, and rescue workers; and,

3.) WHEREAS, The Associated Students sympathize with and mourn for the victims; and,

4.) WHEREAS, The attacks of September 11th started at 8:46 a.m. and organizations across the country are observing a Moment of Silence to take place at exactly 8:46 a.m. on Friday, September 11, 2009; and,

5.) WHEREAS, The Associated Student Government representatives feel that the above is an appropriate and tactful way to observe the 8th anniversary of the 2001 attacks; and, therefore be it,

6.) RESOLVED, The Associated Students of Humboldt State University fully support any and all efforts by any students, clubs, faculty, or staff who so choose to support the action to observe a Moment of Silence, and be it further;

7.) RESOLVED, The Associated Students of Humboldt State wish to provide the means for our students to be free to exercise their right to observe the occasion and be it further;

8.) RESOLVED, The Humboldt State University Associated Students Government hereby support and promote the observance of 60 seconds of silence to take place at exactly 8:46 AM on Friday, September 11, 2009 by all students, faculty, and staff across campus, wherever they happen to be at that moment, in recognition and remembrance of those who lost their lives in the 9/11 attacks on American soil, and be it finally;

9.) RESOLVED, This resolution shall be sent to, but not limited to: CSU Chancellor Reed, all members of the Board of Trustees; HSU President, Rollin Richmond; Vice President of Student Affairs, Steven Butler; Provost and Vice President of Academic Affairs, Robert Snyder; the Academic Senate; all university departments; all local and state media outlets; and all CSU Associated Students.

SUBJECT: Resolution in Support of Supplying Flu Vaccinations, at Little or No Cost, to Students who might have a Financial Hardship

1.) WHEREAS, The Associated Students of Humboldt State University (HSU) has been entrusted to represent and fight in the best interests of our constituents, the students which make up our campus community; and,

2.) WHEREAS, The Associated Students mission is to"…assist in the protection of the rights and interests of the individual student and the student body…and to stimulate the educational, social, physical and cultural well-being of the University community;" and,

3.) WHEREAS, Humboldt State University Associated Students believes that a student's physical well-being is essential to best interact in an educational environment such as HSU; and,

4.) WHEREAS, there has been a recent surge in the number of flu cases on campus and in the surrounding community, including the news that HSU students have contracted the H1N1 flu virus; and,

5.) WHEREAS, the magnitude of the current flu season may require students to receive the vaccine who normally would not need one, and;

6.) WHEREAS, the current price for a flu vaccination is $12.00 per vaccine, which for some students can be determined as a financial hardship; therefore, be it;

7.) RESOLVED, that Humboldt State Associated Students encourages the Student Health Center to provide flu vaccinations, at little to no cost, to students with a determined financial hardship; and be it further,

8.) RESOLVED, that the Humboldt State Associated Students encourages all students, faculty, and staff to take precautionary measures to prevent the spreading of the flu; and be it further,

9.) Category IV Programs Evaluated for Elimination.

RESOLVED: The Associated Students of Humboldt State University recommend, in conjunction with the Provost, that the Office of Enrollment Management (OEM) notify prospective and current students that programs in Category IV are being considered for elimination. Such a system should utilize: the HSU website, e-mail, letters, and telephone calls to notify prospective and current students affected.

RESOLVED: That the Associated Students of Humboldt State University require that the resolution shall be sent to the following: CSU Chancellor, Charles B. Reed; Executive Vice Chancellor and Chief Academic Officer, Jeronima "Jeri" Echeverria; CSSA President, Steve Dixon; HSU President, Rollin Richmond; Provost and Academic Affairs VP, Robert Snyder; HSU Academic Senate; and OEM.

RATIONALE: There is a need for a system of notifying students of the potential elimination of the program in which they are enrolled. It would be unfair to prospective and current students interested in Category IV programs to enroll students without properly informing them of possible program elimination. Dina Haigounian, a student member of the Provost's Council, reported to the Associated Students that she voted in favor of closing enrollment to programs in Category IV. She also suggested that students be notified if the program they applied for may be eliminated. The AS Council has received comments from concerned students regarding Category IV programs considered for elimination. They are concerned about the quality and value of the degree if their program gets eliminated and they are forced to take substitute courses. Iban Rodriguez met with the provost on October 14, 2009 about this matter. The Provost expressed his concern over the possible effect on uninformed students. Additionally he talked about his direction to implement such a system under the OEM.

1.) WHEREAS, The Associated Students of Humboldt State University supports and values diversity while upholding a commitment to commend and partake in acts of social justice that educate the campus and community on issues of diversity; and

2.) WHEREAS, The Associated Students of Humboldt State University (HSU) recognize veterans as a cultural community on campus that is susceptible to harmful negative stereotypes and that these stereotypes create barriers to a safe learning environment and the ability for service members to transition from military life to civilian and/or student life; and

3.) WHEREAS, The Associated Students recognize that military members and veterans return home to every community, including our own, and that it is the responsibility of all communities to assist in meeting the needs of returning service members; and

4.) WHEREAS, the advent of the all-volunteer Armed Forces has resulted in a sharp decline in the number of individuals and families who have had any personal connection with the Armed Forces;

5.) WHEREAS, this reduction in familiarity with the Armed Forces has resulted in a marked decrease in the awareness by young people of the nature and importance of the accomplishments of those who have served in the Armed Forces, despite the current educational efforts of the Department of Veterans Affairs and the veterans service organizations;

6.) WHEREAS, the system of civilian control of the Armed Forces makes it essential that the future leaders of the Nation understand the history of military action and the contributions and sacrifices of those who conduct such actions; and

7.) WHEREAS, in each of the years 2000 through 2008 the Senate has recognized the need to increase the understanding of the contributions of veterans among school-aged children by approving a resolution recognizing the week containing Veterans Day as 'National Veterans Awareness Week': Now, therefore, be it

8.) RESOLVED, The Associated Students designate the week of November 8 through November 14, 2009, as campus 'Veterans Awareness Week' for the purpose of emphasizing educational efforts directed at University students concerning the contributions and sacrifices of veterans; and be it further

1.) WHEREAS, The Associated Students of Humboldt State University (HSU) is the official voice of the students. It is therefore, the mission of Associated Students to fight for the best interests of Students; and,

2.) WHEREAS, To address the state's economic needs, the state of California has slashed funding to the CSU by $584 million dollars, resulting in a $12 million dollar cut to the HSU budget; and,

3.) WHEREAS, The CSU generates a direct economic impact of $7.64 billion annually through its educational efforts; and,

4.) WHEREAS, The budget cuts have resulted in thousands of eligible students being denied access to higher education, which will reduce California's professional class of citizens and the economic benefits such citizens generate; and,

5.) WHEREAS, AB 656 proposes to raise over $1 billion for Higher Education in California, by imposing a 12.5% excise tax on oil producers. Currently no such tax in California exists; and,

6.) WHEREAS, Other states impose up to a 35% tax on oil before it leaves for national markets, resulting in indirect taxation of Californians without contributing any benefit to Californians; and,

7.) WHEREAS, Such a tax would enable the State of California to allow eligible students to attend the CSU through renewed funding. Thus maintaining California's professional class of citizens and the economic benefit the CSU system currently generates; therefore be it,

8.) RESOLVED, The Associated Students of Humboldt State University fully support AB 656; and be it finally,

3.) WHEREAS, The California State Student Association represents over 450,000 students of the California State University System and has a long standing history of representing our students on statewide issues; and,

WHEREAS, The Associated Students of Humboldt State University has held a long standing relationship with the California State Student Association which has included, but not limited to: the sending of representatives, serving as executive leadership, and participating in California State Student Association events; and,

5.) WHEREAS, Many university Associated Students organizations in the California State University have expressed an interest in amending the internal and external operations of the California State Student Association; and,

6.) WHEREAS, As a result, the California State Student Association Board of Directors has passed, and put forward for ratification to the individual Associated Students organizations, a proposal to amend said structure; and,

7.) WHEREAS, Said proposal includes changes to the executive structure of the California State Student Association, dues structure, Executive Director performance evaluations, and proportional voting; and,

8.) WHEREAS, The Associated Students of Humboldt State University passed a resolution on December 15, 2008 which urged "the California State Student Association oppose the [proportional voting] proposal as well to protect the voices of all students regardless of campus population;" and,

9.) WHEREAS, The current harsh climate surrounding the California State University system with continuing budget cuts and system wide impaction, warrants a commitment to working with the statewide representation that the California State Student Association provided for Humboldt State University students; therefore be it,

10.) RESOLVED, that the Associated Students of Humboldt State University approve the proposal set forth by the California State Student Association at the December 2008 plenary meeting with the following qualifications; be it further,

Whereas: the AS Elections Code currently requires that all candidates for an AS elected office pay a performance bond when filing for candidacy and that some students have chosen not to run for office due to the performance bond requirement.

Be it enacted by the Associated Students Council that the following revisions be made to the Associated Students Elections Code.

7.02 At the time nomination materials are filed, the Candidate shall also file a signed statement indicating candidateäó¢íó_í_Œés understanding of the Constitution, Elections Code and other election materials of the Associated Students of Humboldt State University. Candidate shall also file a performance bond as described in Section 8 General Elections Performance Bond.

SUBJECT: Resolution in Support of the Drinking and Utilization of Local Water and the Phasing Out of the Sale of Single- Use Water Bottles at Humboldt State University

WHEREAS, The Mission Statement of the Associated Students of Humboldt State University states that they "[shall be] an official voice through which students' opinions may be expressed; foster awareness of these opinions both on and off campus; provide services and programs as deemed necessary by the corporation to meet the needs of the student and campus community; and to stimulate the educational, social, physical, and cultural well-being of the University community;" and

WHEREAS, Humboldt State and the Associated Students has had a long history of advocating environmental and sustainable responsibility; and

WHEREAS, The HSU Strategic Plan states that its vision for the future is to "provide a socially and environmentally responsible education; and,

WHEREAS, HSU has repeatedly stated its commitment to a sustainable campus and the reduction, reuse, and recycling of natural resource-based products; and

WHEREAS, HSU consumes more than 78,000 single-use water bottles per year; and,

WHEREAS, the production, transportation, storage and disposal of bottled water to meet HSU bottled water demand requires approximately 43 barrels of oil per academic year; HSU contributed approximately 35,300 pounds of CO2 being released into the atmosphere; and,

WHEREAS, the City of Arcata found that the Arcata water system, through Humboldt Bay Municipal Water District's Mad River, is sustainable and environmentally beneficial (fish friendly and nearly carbon neutral); situated in the upper watershed where salmon naturally cannot reach, Arcata’s drinking water is released from Ruth reservoir via gravity, produces emission-free electricity; as the water flows over 75 miles downriver, it supports riparian and aquatic habitats and threatened populations of salmon and steelhead; upon reaching the Essex Narrows, water percolates through the gravel bed forming aquifer where it is pumped from nearly a hundred feet below the surface up to a ridge for disinfection, and again via gravity, flows onward to the City's distribution system; and

WHEREAS, Universities and colleges around the country including Chico State, UC Berkeley, Sarah Lawrence, Vassar, Smith College, Washington University, Oregon State and many others have already made efforts as a campus to curb their bottled water use; therefore, be it

RESOLVED, that Associated Students will strongly discourage the use of AS funds to purchase single-serving bottles of water, be it further

RESOLVED, that the Associated Students will encourage the utilization of refillable containers at its facilities and functions, be it further

RESOLVED, that Associated Students will support efforts to educate the public regarding the value and benefits of using Arcata’s unique water system for all its water needs, be it further

RESOLVED, that Associated Students will support the phasing-out of the sale of single-use plastic water bottles on campus, be it finally

o January 30th, 2008; The Chair left AS meeting to host a Focus the Nation Workshop in which he selected the time for the workshop to be held. The Chair left approximately 1/3 of the way through the meeting and handed off chairmanship to AS Vice-Chair, Ryan Guy; who then had to leave before the meeting was concluded and chairmanship was at this point handed over to Tiffany Newton who concluded the meeting. Three chairs were utilized in one meeting demonstrating a lack of professionalism and poor planning on the part of the Chair in regards to the expedience and organization of governance of the meeting. o February 13th, 2008; late to meeting and left early, Vice-Chair facilitated meeting.

o February 27th, 2008: Started meeting on time, gave his report basically saying he would be missing the entire meeting, handed off duties of Chair to the Vice-Chair and then left and did in fact miss the entire meeting. NOTE: This was the first meeting where The Chair expressed that he had a class conflict with meeting times. (See section 8.02g for explanation on missed meetings)

o The legislative V.P. has continually interfered with the ability of the C.S.S.A. representatives to conduct AS business during their official office hours.

Holding 'club' meetings within the A.S. office particularly in the Legislative Affairs/C.S.S.A. office.

Hindering efficient operations within the CSSA and Legislative VP office by allowing or condoning computer operations that have slowed the business and use of the new CSSA/Leg VP computer.

o The Chair has excessively used the A.S. phone to conduct non-A.S. business on numerous occasions.

o The Chair has excessively made photocopies and used the AS fax machine for non-Associated Student business.

Governmental code 10.6 in reference to Standing Rules Section I. H: "That all members are expected to comport themselves in accordance with the respectful attitude necessary to conduct business meetings."

Showed blatant disrespect for council, presenters, and guests of AS at the February 27th, 2008 meeting. At this time Robo conducted himself in an unprofessional manner unbecoming of an Officer of an Auxiliary Organization. His behavior was hostile and aggressive, choosing to talk over people and not respect the rules of order which it is his duty to not only respect and uphold, but to also set an example for the rest of council in regards to how AS meeting are intended to be conducted. His behavior reflected poorly on AS as a whole and hence is damaging to the organization.

o The Chair made derogatory comments to C.S.S.A. representative Rachel Rodriguez, when questioned during his chair report on February 27, 2008.

o The Chair continually and habitually disrespects university officials during both meetings and phone conversations. For example; at the January 23rd meeting The Chair was rude and disrespectful to Dr. Steven Butler, Vice President of Student Affairs during his public comment report on the state-wide budget situation.

AS Government Code 8.02(d) Overstepping the bounds of their office without the advice or consent of Council;

The Chair has used his notoriety as an A.S. official to make derogatory comments as to the conduct and reputation of Terra Rentz, A.S. President; Rob Christensen, A.S. Secretary; and the Associated Students organization as a whole. This has been done without prior notice being given the above mentioned parties to defend and counterpoint his allegations.

The Chair has routinely been disrespectful and intimidating to Humboldt State University Staff. Most notably the staff in Student Affairs and Academic Affairs to the extent that these individuals have become hesitant to work with the association which has in turn negatively impacted Council's ability to conduct business. For Example; in Fall semester The Chair, without prior notification, brandished a video camera and "stuck it in the face" of Kate Stroup, Administrative Assistant, in an effort to document her response to questioning. In addition, during Parents Weekend Associated Students received hesitation in allowing a parent's pledge table due to fears by staff within Student Life that The Chair would be present and unprofessional.

äó¢íó_äó¢íó_ The Chair routinely disrespects one of the highest priority committees on this campus, Academic Senate, in which he is responsible for representing Associated Students. By not following Standing Rules Section I. H he has shown disrespect to the Academic Senate Chair to and Academic Senate members by not following Parliamentary Procedure, by not speaking within time limits set by the chair, and by publicly insulting members of the board.

AS Government Code 8.02(e) Continuous failure to attend assigned committee meetings;

The Chair has missed every meeting of the University Curriculum Committee for the spring 2008 semester (5 meetings total) and the majority of all U.C. C. Meetings for the 2007-2008 school year. (Has missed 7 out of 12 meetings of the U.C.C. for 2007-2008)

AS Government Code 8.02(g) Undue interference in Council's implementing its decisions;

Decided to cancel AS Council meeting on February 27th, 2008 and reschedule meeting without the consent of council. This cancellation was not in accordance with the Gloria Romero Open Meeting Act. This caused confusion and resulted in one of our members not attending the meeting.

The Chair set a Special Meeting on March 3rd. This action on the part of the Chair disbarred many members from having the opportunity to discuss new scheduling as a result of the Legislative V.P.'s decision to schedule a class during set council meeting times.

NOTE: Legislative V.P. chaired the meeting on December 10, 2007 during which the change in meeting dates and times was voted on and approved unanimously by council.

4.) WHEREAS, State executive and legislative decisions have cut the California State University system budget by 312.9 million dollars; and,

WHEREAS, The reduction to the CSU budget has the potential to drastically affect the affordability, accessibility, and quality of education for the CSU system as a whole, which includes students throughout the state of California, from continuing CSU students, transfer students from community colleges, high school graduates and all residents of California; and,

6.) WHEREAS, The CSU system produces high numbers of educated workers who contribute directly to the economic prosperity of California, the fifth largest economy in the world; and,

7.) WHEREAS, The California State Student Association is organizing a student march for higher education on April 21, 2008, in opposition to the states decision to cut the CSU budget and is inviting all phases of the higher education system of California to participate; and,

8.) WHEREAS, The purpose of the march is to ask the state legislators, the governor, and the public at large to invest in our future, and that of California's and to motivate the afore mentioned, to more fully support the CSU system, hence California's economic prosperity via higher education and provide the higher education systems, specifically the CSU system with an increase in funding or by re-examining the decision to decrease the CSU budget and, be it further,

1.) WHEREAS, the Associated Students Administrative Code currently does not address the structure, composition, and responsibilities of the Humboldt State Associated Students Lobby Corps;

Be it enacted by the Associated Students Council that Administrative Code, Section 12, 12.01, 12.02, 12.03, 12.04, and 12.05 be inserted to read the following:

Section 12. Humboldt State Associated Students Lobby Corps

12.01 The Humboldt State University Associated Students Lobby Corps shall be responsible for working closely with HSU Associated Students and to lobby on behalf of the students at Humboldt State University and the Association in regards to specific issues that are affecting our University and the North Coast.

12.02 The Humboldt State University Associated Students Lobby Corps shall be Co-Chaired by the A.S. President and the CSSA Representative who shall enlist the service of four (4) students at large to aid in the fulfillment of the purpose of the Lobby Corps.

12.03 The four (4) students at large shall be appointed by the AS President in consultation with the CSSA Representatives. The students at large shall be confirmed by a majority of council.

12.04 The AS President and CSSA Representative shall:

a. Be responsible for the general coordination of The Humboldt State University Associated Students Lobby Corps including formulation of meetings;
b. Conduct interviews for the candidates for the student at large positions in which some level of lobbying or communication skill has been demonstrated;
c. Schedule and organize a mandatory "lobby training" early in the fall semester for the The Humboldt State University Associated Students Lobby Corps members and open to the Associated Students Council;
d. Schedule and organize a mandatory "effective communications training" early in the fall semester for The Humboldt State University Associated Students Lobby Corps members and open to the Associated Students Council;
e. Attend AS Council meetings and report to the Council regarding the progress of the HSU Lobby Corps;

12.05 The duties of the Co-Chairs shall be split as follows:

The AS President shall be responsible for staying abreast on campus specific issues and informing the committee on these issues.

The CSSA Representative shall be responsible for staying abreast on California State University wide issues and informing the committee on these issues.

12.06 In consultation with the AS President and the CSSA Representatives, the duties of the four (4) students at large shall be split as follows:

Two (2) Students at Large members shall:
a. Specialize and focus on the California Senate through research and staying abreast on current issues;
b. Organize and attend monthly communications with the local office for our district Senator;
c. Organize and attend three (3) Sacramento lobby visits, two (2) in the Fall and one (1) in the Spring, in cooperation with The Humboldt State University Associated

Students Lobby Corps membership;
d. One (1) student shall:
i. Focus on higher education issues affecting Humboldt State;
ii. Research, watch, and organize lobby appointments with the Senate Committee for Higher Education and all other Senate members who have an influence on higher education issues.

e. One (1) student shall:
i. Focus on an issue as deemed necessary and pertinent to the students at Humboldt State University and the North Coast by The Humboldt State University Associated Students Lobby Corps membership in consultation with the Associated Students Council;
ii. Identify Senate committees pertinent to the aforementioned issue;
iii. Research, watch, and organize lobby appointments with the identified Senate Committees and all other Senate members who have an influence on the issue.

Two (2) Students at Large members shall:

1.) WHEREAS, the Provost Council is charged with assisting "the Provost and Vice President for Academic Affairs with policy issues and major areas that need broad consultation."

2.) WHEREAS, the Associated Students Administrative Code does not address the relationship of the Provost Student Representative to sub committees inherently necessary for the student representative to make informed decisions.

3.) WHEREAS, the Provost Council is a centralized board that deals with information brought to it by many sub committees and boards including but not limited to the Chair of the University Curriculum Committee, Chair of the Academic Senate, and Representative of the Statewide Academic Senate.

4.) WHEREAS, the current process for Academic Program Review is changing from a Department generated report and assessment into a more centralized review by the Provost's created Academic Program Prioritization Task Force,

5.) WHEREAS, the Provost Council's Student representative's access to information needs to be broadened beyond department level information,

6.) WHEREAS, the decisions effected by budget shortfall are being more centralized by the administration including reviews of Academic Program performance Be it enacted by the Associated Students Council that the Administrative Code Section 12 of the Associated Students Constitution be adopted as follows:

Section 12: Student Interrelations Committee for Quality Academics

12.01 The Student Interrelation's Committee for Quality Academics shall consist of the Provost's Council student representative acting as Chair and appointed by the A.S. President, one student serving from the Academic Affairs Budget Committee appointed by the A.S. President, one student from the Instructionally Related Activities Committee appointed by the A.S. Vise President, one student from the Student Fee Advisory Committee (SFAC) appointed by the A.S. President, one student from the Joint Assessment Committee appointed by the A.S. President, one student from the Educational Policies Committee appointed by the A.S Legislative V.P., one student from Enrollment Management Advisory Committee appointed by the A.S. Student Affairs VP, one student from the University Curriculum Committee appointed by the A.S. Student Affairs V.P.

12.02 The Committee Shall:

-meet at least 2 times a semester and shall not meet the first month of the year so as to allow appointments to other committee positions, that are necessary for the Student Interrelations Committee to have membership, be given time to already have taken place.

-discuss and document the interrelation of actions taken in their separate committees

-discuss relationships with administration and how to improve their relationships with effective action and communication in those separate committee's.

-serve as an advisory group to the Provost Council Student Representative

-put on a fall Student Interrelations Committee for Quality Academics event that invites all committee representatives to attend an informative gathering that makes connections between other representatives, makes connections between people working on similar issues, and encourages committee student representatives to focus on a goal, this event should not be any earlier than two months after the school year begins-put on a spring Student Interrelations for Quality Academics Event that invites all committee representatives to record relationships, helpful contacts, common problems faced, and goals left over in some media form that will carry over the next year,

As student Advocates We Shall: be vocal on issues that protect and increase student rights; create opportunities to increase the student perspective in the university decision making process; actively seek institutional changes that serve to enhance the student environment; and uphold and protect the integrity of the Student Body Association;äó¢íó_í_Œ and,

WHEREAS, IT IS IN THE MISSION OF THE ASSOCIATED STUDENTS to advocate for the student perspective to the äó¢íó_äó¢íó_äó¢íó_appropriate parties,äó¢íó_í_Œé which on this topic includes but is not limited to; the university administration, the University Center Board of Directors, the local community, and the State of California; and,

WHEREAS, THE HISTORY OF HUMBOLDT STATE UNIVERSITY CENTER STATES, äó¢íó_äó¢íó_äó¢íó_Under the theory that a group of articulate and dedicated students and faculty leaders could successfully determine and state creatively the problems and solutions to a proposed COLLEGE UNION at Humboldt State, the college President created a committee to start the planning of such a Union in 1956. Associated Students, College Union Proposal, 1966;äó¢íó_í_Œ and,

6.) WHEREAS, THE HISTORY OF HUMBOLDT STATE UNIVERSITY CENTER STATES, äó¢íó_äó¢íó_äó¢íó_In September 1965, a new College Union Foundation Planning Committee was established by Dr. Siemens for their recommendations in creating a College Union Board of Directors. This Board of Directors would be charged with the responsibility of the operations of the College Union. Consultation with state agencies indicated that it would be feasible to incorporate the cafeteria, the bookstore, and Nelson Hall in one College Union Building. The ASB Legislative Council created a College Union Steering Committee for the purpose of äó¢íó_äó¢íó_äó¢íó_planning a campaign to establish a College Union on campus.äó¢íó_í_Œé A group in excess of fifty active members including many club presidents, was appointed as members of the various committees that were formed.äó¢íó_í_Œ äó¢íó_äó¢íó_äó¢íó_In 1970 the College Union incorporated and OWNERSHIP of the bookstore was transferred to the Unionäó¢íó_äó¢íó__ on October 10, 1972 the board named the NEW STUDENT UNION, the University Center;äó¢íó_í_Œ and

7.) WHEREAS, THE BYLAWS OF HUMBOLDT STATE UNIVERSITY CENTER BOARD OF DIRECTORS, Section 2. READS, äó¢íó_äó¢íó_äó¢íó_The purpose of the University Center is to provide the students of Humboldt State University with services, conveniences, and amenities requisite to the daily life of campus. These services, conveniences, and amenities will also be provided to the campus community consisting of faculty, administrators, staff and alumni, guests of the student body or campus community, as well as the general public, as long as such provisions will result in direct or indirect benefits to the students of Humboldt State University. Should conflicts arise between the aforementioned service groups, priority shall be given to students, campus, community members, and the general public in descending order;äó¢íó_í_Œ and,

8.) WHEREAS, THE BYLAWS OF HUMBOLDT STATE UNIVERSITY CENTER BOARD OF DIRECTORS, Section 4. READS, äó¢íó_äó¢íó_äó¢íó_It shall further be the purpose of the Board that the net earnings will be used for the benefit of the students of Humboldt State University, and that no part of the net earnings will inure to the benefit of any private individual;äó¢íó_í_Œ and,

9.) WHEREAS, CALIFORNIA STATE LAW, EDUCATION CODE READS, äó¢íó_äó¢íó_äó¢íó_Section 89905.5. (a) No auxiliary organization operating a commercial service on the California State University, Chico, campus shall discontinue that commercial service without providing the campus with adequate notice of its intent to discontinue the service, and the opportunity to continue the service through another means. (b) No commercial service operated by an auxiliary organization on the California State University, Chico, campus or any aspect of the management of the commercial services shall be taken over by the Trustees of the California State University, the Chancellor of the California State University, the president of a campus of the California State University, or another auxiliary organization unless all of the following conditions are met: (1) The entity seeking to assume all or part of the management of the commercial service has demonstrated that the commercial service has substantial programmatic or financial difficulties. (2) The governing board of the auxiliary organization currently operating the commercial service has been provided adequate opportunity to respond to the concerns demonstrated pursuant to paragraph (1). (3) The governing board of the entity seeking to assume all or part of the management of the commercial service has approved the assumption of the new programmatic or financial responsibility. (4) The auxiliary organization currently operating the commercial service has been provided adequate compensation for any losses, including, but not limited to, property, inventory, services, or employees directly resulting from the assumption of all or part of the operation of the commercial service by the entity. (c) If an entity assumes responsibility for commercial services pursuant to subdivision (b), the entity shall be established as an official California State University auxiliary organization operating separate from, but related to, the university of service so as to protect the state from all possible liability associated with the operation of commercial services;äó¢íó_í_Œ therefore, be it,

10.) RESOLVED, we the Associated Students of Humboldt State University do hereby request that President Rollin C. Richmond, any and all administrators of Humboldt State University & The Student Union--- University Center Board of Directors and desist any and all plans to transfer any commercial services out of, or reorganize from within, the University Center Board of Directors, a student majority board with a student chair, unless said transfer includes full and complete oversight by the current UC boards bylaws mentioned previously in this document.; be it further,

11.) RESOLVED, That we the Associated Students of Humboldt State University do hereby request the California State Legislature to fully incorporate Humboldt State University along with California State University Chico in Education Code, Section 89905.5; be it further,

RESOLVED, That we the Associated Students of Humboldt State University as the official voice through which students opinions may be expressed, do hereby request that any Student Representative on the University Center Board, both elected & non-elected, whether Ex-officio, Student-at-large, and/or RHA Representative, neither support in discussion, nor in voted form, any proposed transfer or reorganization of any commercial service out of or within the Student Union, University Center Board of Directors, unless said transfer includes full and complete oversight by the current UC boards bylaws mentioned previously in this document. ; be it further,

1.) WHEREAS, The Associated Students of Humboldt State University (HSU) recognize that the attacks of September 11, 2001 affected all Americans and the world, not just the direct victims and their families; and

2.) WHEREAS, The AS members and representatives acknowledge the tragedy that took place on this day and refuse to forget the sacrifice that was willingly and unwillingly made by the victims, their families, and rescue workers; and

3.) WHEREAS, The Associated Students sympathize with and mourn for the victims; and

4.) WHEREAS, The HSU College Republicans in conjunction with the Veterans Club have suggested a Moment of Silence to take place at exactly 9:11 AM on Thursday, September 11, 2008 by all willing students, faculty, and staff across campus, wherever they may be at that minute; and

5.) WHEREAS, The Associated Student Government representatives feel that the above is an appropriate and tactful way to observe the 7th anniversary of the 2001 attacks; and, therefore be it,

RESOLVED, The Humboldt State University Associated Students Government hereby support and promote the observance of 60 seconds of silence to take place at exactly 9:11 AM on Thursday, September 11, 2008 by all students, faculty, and staff across campus, wherever they happen to be at that moment, in recognition and remembrance of those who lost their lives in the 9/11 attacks on American soil. We feel that this action, sponsored by the HSU College Republicans and the Veterans Club, is an appropriate and tactful way to observe the 7th anniversary of the 2001 attacks, and be it finally;

9.) RESOLVED, This resolution shall be sent to, but not limited to: CSU Chancellor Reed, all members of the Board of Trustees; HSU President, Rollin Richmond; Vice President of Student Affairs, Steven Butler; Provost and Vice President of Academic Affairs, Robert Snyder; the Academic Senate; all university departments; all local and state media outlets; and all CSU Associated Students.
